- Abstract
The article discusses the impact of the U.S. Supreme Court's (USSC) ruling in the 2011 case Sorrell v. IMS Health Inc. which deals with Vermont's statutory ban on the sale or disclosure of information by pharmacies regarding the prescribing habits pf physicians. The U.S. Constitution's First Amendment protections against the unlawful disclosure of private information are examined, including an analysis of the U.S. Supreme Court's ruling in Sorrell in the context of free speech rights. The ability to impose a content-based regulation on speech is addressed in light of the USSC case Holder v. Humanitarian Law Project.
