- Title
CONFRONTING OUR FEAR: LEGISLATING BEYOND BATTERED WOMAN SYNDROME AND THE LAW OF SELF-DEFENSE IN VERMONT.
- Authors
Cookson, Cara
- Abstract
The article provides a historical background on the admissibility of expert testimony on battered woman syndrome (BWS) and the law of self-defense in Vermont. It examines how the comprehensive remedy provided by the model statute complements the state's existing state law and progressive values. It infers that despite the potential legitimacy of BWS as a psychological condition, it has reached the limits of its usefulness as a self-defense theory. Moreover, it suggests the need for legislature to adopt a justifiable domestic homicide statute rather than perpetuating reliance on self-defense coupled with expert evidence on BWS.
