- Abstract
The article compares the right to health in the domestic legal systems of Colombia and South Africa. This right has been entrenched as a justiciable guarantee in Colombia since 1991 and in South Africa since 1996. The evidence of justiciability is disaggregated into four variables including doctrinal arrangements, judicial roles, private financing arrangements and configurations of civil society. The impact of the right of health on the legal design around health care and human rights is noted.
