- Abstract
This article intends to analyze the contemporary legal argumentation, understood as a rational rhetoric which aim is to legitimate class interests. Therefore, it discusses the law's role as an element of social control, as well as the historical attempts to legitimate it as the bearer of truth (in Greece), of science (in Modern World) and of reason (in the present). The text adopts a critic perspective when it demonstrates the loss of credibility of the State and the power, which find themselves forced to resort to the supposedly rationalized speech of jurists and judges that are not committed to the justice, but to the logical argumentation, and, thereby, end up occupying the post of power's organic intellectuals.
