- Abstract
Background: Health was first established as a citizen's right from the Constitution of the Republic of 1988. The definition of health as a State policy made it possible for brazilians to seek their rights through judicial measures. Objective: analyze and describe the relevant aspects of the medication requests made by lawsuits towards the Health Department of the city of Ipatinga, Minas Gerais. Methods: This is a descriptive, documentary research, with a retrospective design. Results: During the period evaluated, 537 drugs were delivered, making up 09 main pharmaceutical classes and 254 different users. 94.8% of the drugs were registered among the Ministry of Health, and of these, 64.4% are in accordance with the Common Brazilian and / or International Denominations DCB / INN. In 71.1% of the cases, the drugs did not belong to any official list from the Health Unic System (SUS); Those belonging to these lists, the majority were part of REMUME (15.7%). Lisdexamphetamine was the most widely supplied drug by court order (15.4%). The majority of users were female (58%). Conclusion: Considering the current process of health judicialization, we must weigh the pros and cons of this process. The Pharmaceutical services of all cities must work intensively and continuously, in order to formulate strategies that guarantee the population's access to health, without prejudice to the community.
