- Abstract
The article offers background information on cases that have addressed Section 1782 Title 28 of the U.S. Code, a federal statute that allows a litigant to a legal proceeding outside the U.S. to apply to an American court to obtain evidence for use in the non-U.S. proceeding. Topics covered include the widening split among the U.S. courts as to the definition of foreign or international tribunal, and the Servotronics cases that have highlighted the circuit court split on this issue.
