- Abstract
The article examines the evolution of the 'bad faith' exception to the 1-year time limit for case removal to U.S. federal courts based on diversity jurisdiction. Also cited are the aim of the exception to prevent plaintiff forum manipulation, the proposed flexible framework to balance the limited nature of diversity jurisdiction, as well as the consideration by the Western District of Kentucky court of the 'bad faith' exception in 'Taylor v. King.'
