The article focuses on the role of originalism in the struggle for control of the U.S. Constitution, which is playing out in Californian federal courts. It states that the immediate ground of the issue is the state Proposition 8, by which almost 53% of the state voters turned down gay marriage. It says that originalism has been receiving supports from constitutional scholars, citing the success of the Federalist Society.
