The article discusses whether liberal criminal procedure causes punitive substance in America as of March 2014, focusing on the U.S. criminal justice system, the nation's Supreme Court, and the preliminary evidence from several natural experiments. Various U.S. legislative and prosecutorial powers are mentioned, along with constitutional procedural rights and plea bargaining in America. William J. Stuntz's book "The Collapse of American Criminal Justice" is also examined.
