AMICUS BRIEFS IN INDIAN LAW: THE CASE OF PLAINS COMMERCE BANK V. LONG FAMILY LAND & CATTLE CO.
- Authors
POMMERSHEIM, FRANK
- Abstract
The article discusses the amicus brief in the U.S. case of Plains Commerce Bank v. Long Family Land & Cattle Co. In the case, the court ruled that tribal courts do not possess the jurisdiction over the sale of fee land on the Reservation by a non-Indian bank to a tribal member or Indian-controlled corporation. In South Dakota, there has been an uninterrupted record of filing the amicus briefs in opposition to tribes in all cases involving jurisdiction over non-Indians.
