- Abstract
The article analyzes the circuit court split on tester stigmatic in-jury standing under Article III of the U.S. Constitution, and concludes that the conflict between Havens Realty Corp. v. Coleman and TransUnion v. Ramirez is untenable. Topics discussed include tester stigmatic injury standing in the Second, Fifth, Tenth and Eleventh Circuits, the rationale for each court's decision, and options to resolve the conflict.
