- Abstract
The article focuses on the constitutional legitimacy of state-sanctioned trespasses in the name of speech. The U.S. Supreme Court ruling in the PruneYard Shopping Center v. Robbins case states that the shopping center owner required by the California state court to grant political solicitation and speaking rights to strangers was not deprived of compensation and free speech rights. It stresses that such decision is not basis for imposing obligations on private landowners. It concludes that the ruling was closer to the factual circumstances of the case.
