- Abstract
To grant the same rights to all people legally residing in the territory of the EU, regardless of citizenship, means recognition of their legal stay and participation in the cultural, social, working and political life of the EU. Analysis of the relevant literature, and both domestic and foreign regulations shows that front of EU legislation raises two fundamental problems in terms of non-discrimination on grounds of nationality. One relates to the validity of human rights relating to freedom of movement, and the other to fight against discrimination in terms of freedom of movement. There is no society that is resistant to discrimination, because discrimination limits the freedom of people, restricts them to improve their skills, which affects productivity, competitiveness and overall economic success.
