- Abstract
The article analyzes the court's ruling in the case Robins Dry Dock & Repair Co. v. Flint, and uses it to illustrate a kind of nonactionable pure economic loss called relational economic loss. It offers an analysis of the prevailing "economic loss rule" rationale to the nonrecovery of economic loss, and proposes that an alternative approach based on the general laws of negligence can be applied. The common explanation of pure economic loss is challenged while an analysis of general laws of negligence, particularly foreseeability is offered.
