- Abstract
The article describes the court case of Vergara v. California wherein Judge Rolf Treu declared the seniority protection laws of California unconstitutional because they limited minority access to effective teachers. Judge Treu said that California's current policies are unconstitutional and it is up to legislature to change the laws. The U.S. Department of Education requested states to present the ways they are ensuring equal student access to effective teachers to easily resolve similar cases.
