- Title
AMENDING THE UNWRITTEN CONTRACT: CLAIMS FOR COMMISSION AND UNJUST ENRICHMENT.
- Authors
Woodhouse, Holly
- Abstract
The recent case of Bing Holdings v Hue-Williams offers a firm reminder of the need to make timely requests to amend a claim and also reaffirms the subtle distinction between a contract claim for payment of a reasonable sum and a true quantum meruit claim in unjust enrichment. It also underlines the importance, yet again, of committing to writing the terms of a contract which potentially involves the payment of very large sums of money.
