- Abstract
The article discusses U.S. courts' adoption of a random access memory (RAM) copy doctrine that treats all temporary digital instantiations as copies under the Copyright Act. It examines scholars' criticism of the policy implications of the Ninth Circuit court case "MAI Systems Corp. v. Peak Computer Inc." and the Second Circuit's decision in "Cartoon Network v. CSC Holdings." Considerations that explore the scope of transitory duration are also discussed, including its application in the context of copyrightability.
