- Title
Internet Intermediary (ISP) Liability for Contributory Copyright Infringement in USA and India: Lack of Uniformity as a Trade Barrier.
- Authors
Kumar, Aakanksha
- Abstract
The article discusses the internet service provider (ISP) liability laws for contributory copyright infringement in India and the U.S., focusing on the lack of uniformity as a trade barrier. It states that the law in the U.S. has been very strict against ISPs for secondary/contributory copyright infringement, while India has not long enacted a legal provision addressing ISPs. It says that the lack of ISP liability has been the major factors behind the delay in Indo-U.S. free trade agreement.
