- Abstract
An essay is presented on the extraterritorial application by statutes and case law of U.S. environmental laws. It offers factors that help explain the legal landscape such as the potentially massive scope of extraterritorial application of environmental laws, the obstacles associated with standing doctrine, and the way that courts frame cases such that extraterritorial application of environmental laws will be minimized. The extraterritoriality of environmental laws should be reexamined.
