- Abstract
The article examines the judgment approaches regarding the rules of communal membership in the U.S. and Canadian justice administration. It offers an analysis on the decision of the U.S. Supreme Court in the case Hastings Christian Fellowship v. Martinez and colleagues, raising issues of religious and associative freedom. It analyzes judicial strategies such as group-based autonomy, substantive engagement with membership norms and group-based autonomy with procedural conditions.
