- Abstract
The article discusses a court case wherein a district court adopted the continuing seizure of concept which the author considers as consistent with the common law arrest definition of seizure. In the United States v. Dupree, the U.S. District Court for the Eastern District of Pennsylvania relied on the Third Circuit's precedent of continuing seizure. The author finds the holding in Dupree as inconsistent with both Fourth Amendment case law in general and calls for reversing the district court's holding.
