- Abstract
The article discusses the regulatory framework for crypto assets and their categorization. It emphasizes that the diversity of cryptocurrencies poses a challenge for regulation. Various types of tokens are explained, including payment tokens, asset-backed tokens, utility tokens, hybrid tokens, and pre-functional tokens. The European regulation of the crypto market and the German law on the introduction of electronic securities are also mentioned. The MiCa regulation is expected to come into effect at the end of 2022 and will regulate both issuers and service providers of crypto assets. At the national level, the eWpG has been passed, which enables the introduction of digital securities. The KryptoWTransferV regulates the transfer of crypto assets and subjects financial service institutions to the due diligence obligations of the anti-money laundering law.
