- Abstract
German Judicial System has the main basic principle in the rule of law; or in german language it is called: ” Rechtssaat ”. This can be defined and explained that every decision and every action taken by authorities has to be according to law of R.F. of Germany. Also, every decision taken by any kind of authority can be demanded in front of courts of R.F of Germany. The legal system of Germany; which is by default in the group of countries that practice Euro-Continental legal system, has a lot of differences from countries that practice Anglo-American legal system. So, in countries that practice Anglo-American legal system, courts make their decission in a concret case, based on the prior cases ( case law ). But, in Germany, which country operates on a base of Euro-Continental legal system, judges make their decission according to legal German codes. In Germany, legislation sets out abstract legal principles and judges should decide on specific cases based on these standards. So in this scientific work, we will make known some of the specifics of the German civil legal system.
