- Abstract
The article analyses a court decision related to the arbitration of uninsured motorist in Pennsylvania. The court refused to reverse arbitrator's decision in favor of insured against his insurer under an uninsured motorist policy, where arbitrator found that exclusion in other motorist's liability policy, which in effect denied motorist coverage for the particular accident, rendered the motorist an uninsured motorist, notwithstanding willingness by the motorist's insurer at a later date to withdraw its disclaimer and assume responsibility. In affirming a lower court's confirmation of the award, the court found that an arbitrator's decision can only be reversed if there is clear, indubitable evidence of fraud.
