- Abstract
The article discusses various changes to the Florida Constitution and the state's Administrative Procedure Act (APA), and it examines whether government agencies in Florida that are given constitutional directives on rulemaking are able to create rules outside of the authority of the APA. A Florida constitutional amendment involving medical marijuana is addressed, along with Florida's Department of Health (DOH) and Division of Administrative Hearings (DOAH).
