- Abstract
The article focuses on the decision of the court case Neponsit Property Owners' Association v. Emigrant Industrial Savings Bank, for examining the mortgage loan regulations in the developments of common-interest communities. It emphasized the need of regulatory changes to avoid failure of regulatory system in prevention of mortgage crisis. It discusses the challenges in implementation of financial restrictions on the market place because of the inability to foreclose on borrowers.
