- Title
Looking Backward to Move Forward with Your Defense: Using History to Overcome Jurors' Misunderstandings About Science.
- Authors
Parker, Bruce R.; Gray, David S.
- Abstract
The article focuses on the need for a defense counsel to recognize the misunderstandings of jurors on medical and scientific evidence to better defend the defendant. It investigates why historical examples of incorrect reasoning may serve as a tool for recognizing the errors to undermine the views of the plaintiff's expert, educate the jurors on the proper evidence evaluation, and humanize defense witnesses. Also discussed is how defense lawyers can reveal weaknesses of the plaintiff's proof.
