- Abstract
The article examines the case of Jourdain de l'Isle, a French nobleman hanged in 1323 for lèse-majesté. It aims at a critical discussion of the dominant paradigm in the medievalists' perception of late medieval France – namely, the systematic domestication of the baronial nobility and the even more systematic construction of a „modern" monarchical state by the kings and their councillors. At first glance, Jourdain's trial fits in exceedingly well into this narrative: Jourdain had been very active in waging private war, thus his execution can be seen as an initial step towards the repression of noble violence by the French monarchy and its claims to sovereignty. Still, Jourdain's case is far more complex, as closer analysis reveals. The ignoble end of this tumultuous nobleman must not be interpreted as the result of a royal policy of repressing all „treasonous" private wara. Rather, it was the result of factional politics: Jourdain fell prey to two converging conflicts that divided both the Avignonese curia on the one hand, and the French court on the other. It was this specific context which alone enabled Jourdain's local enemies to make use of the royal courts in order to destroy their opponent. In light of this observation, the article pleads for an approach which analyses the French monarchy in terms of a „statebuilding from below" and which, at the same time, pays more attention to factional conflicts. In so doing, the article suggests perspectives for the further analysis of late medieval „political" trials.
