REMOTENESS OF CONTRACTUAL DAMAGES.
- Authors
Halladay, John
- Abstract
In this article the author discusses the implication of the court's decision regarding a case concerning the remoteness of contractual damages in Great Britain. In the case of Transfield Shipping Inc. versus Mercator Shipping Inc, the House of Lords decided to restrict the damages presents for the breach of charterparty caused by the late re-delivery of the ship. The author stresses that the decision is important for the development of the doctrine of remoteness of damages in contract law.
