Landmark Decision About Access to Mental Health Records.
- Abstract
The article reports on the decision of the Massachusetts Supreme Judicial Court overruling previous law on the issue of balancing a defendant's right to a fair trial with that of a mental health patient to confidentiality in his or her treatment records. The ruling invalidated the conviction of a man who had served 3 years in prison for sexual abuse. Treatment records that are subpoenaed to court can be reviewed by defense counsel only, rather than by the trial judge.
