Der Aufsatz analysiert den Denkstil eines "guten" Juristen, wobei unter "gut" nur die professionellen Fähigkeiten, nicht aber das moralische Gute verstanden werden. Gemäß dem Autor ist ein guter Jurist engstirnig in dem Sinne, dass er sich auf juristische Argumente konzentriert und all die anderen (zB moralische oder ökonomische) Argumententypen ins Juristische übersetzt. Eine andere Eigenschaft ist die pragmatische prozedurale Herangehensweise, die die Durchsetzbarkeit und nicht die materiale Rechtsfrage in den Mittelpunkt stellt. Letztlich ist der wichtigste Zug eines guten Juristen das Denken in zwei Schichten. Dieses bedeutet, dass er sowohl dem internen (typisch juristischen) Kriterium der juristischen Argumentation, als auch dem externen Wertungskriterium entsprechen soll.
