- Abstract
The article presents an evaluation of two recent federal appellate decisions, which addressed some important issues, such as employees' grievances, under the Family and Medical Leave Act (FMLA). The denial of leave of a plaintiff for a serious health condition in violation of the FMLA, has been focused on. The 10th U.S. Circuit Court of Appeals held that an employer, who violated the FMLA, must pay liquidated damages to the employee claiming the violation. The article also highlights on some instances of the damage provisions for employees with grievances.
