- Abstract
The article focuses on issues of elder abuse statutes and traditional medical malpractice negligence to uncover the problem of inadequate pain management for the elderly and terminally ill. Elder abuse may be defined in terms of abuse or neglect, for which a typical state statute concerning elder abuse and neglect may define these terms in two main ways, such as the characterization of elder abuse as a wilful act of physical or mental harm, and the failure to provide necessary services. various health care norms and suggestions have been discussed. It focuses on the finding of a balance between fighting illegal drug users and guarding against negligence by both the legal and medical systems.
