- Abstract
During the nineties, questions of security acquired significant social relevance in Italy. The demand for a greater application of repressive and penal resources, in particular towards such marginal groups as migrants, was taken up by the political parties to such an extent that it influenced the results of elections. This article monitors the extent to which the security climate has influenced the production of legal output, also in the area of juvenile justice. In particular, it analyses the trend in the response to juvenile delinquency furnished by the Juvenile Court in Bologna, a city whose demographic and social characteristics combine with its geographical location to make it a significant case study. The article reveals that the low level of punishment meted out by the Italian juvenile justice system stops short on the threshold of nationality. Foreign and nomad juveniles pay the price of their marginal origins, which in concrete terms translate into the lack of the landmarks of family and friends and an absence of educational and professional openings, so that they end up as the more numerous groups of inmates in Italy's juvenile detention centres.
