- Abstract
The article discusses the legality of the offshoring of medical information and discusses situations in which offshoring arrangements should be addressed, including situations related to the U.S. Health Insurance Portability and Accountability Act (HIPAA), business associate contracting and arrangements with Medicare Advantage and Prescription Drug plans. A discussion of guidelines which can be used to address situations related to offshoring, and of provisions which can be utilized in offshoring contracts, is presented.
