- Abstract
The article examines the company's sales objectives and procedures in the process of corporate bankruptcy. The article argues that the goals of the sale of the company do not meet the classic goals of the bankruptcy process, as it is related to the broader economic and social goals that can be achieved by realizing the whole company as an asset. The article focuses on the comparative analysis of foreign legal regulation, examines how this procedure is regulated in the bankruptcy law of Estonia, Latvia, Poland and France. The procedure for the sale of a company established by the Law on Insolvency of Legal Entities and its problems are also examined. The authors explain how the sale of the company must be ensured at the earliest possible stage of the bankruptcy process, make a proposal to change the procedure for the sale of the company, including the court. It analyzes how proposals to buy a company should be submitted, what actions should be performed by the insolvency administrator, how the interests of the company's employees should be ensured and what requirements should be established by law for the buyer of the company.
