- Abstract
The article discusses the impact of extralegal punishment factors such as forgiveness, hardship, and remorse on the criminal punishment decision making process in the U.S. as of April 2012. It states that several state legislatures have recognized certain extralegal factors as grounds for mitigation, but a sentencing judge is reportedly not required to take any of these factors into consideration. The U.S. Supreme Court case United States v. Booker is also mentioned.
