- Abstract
The article examines the element in the U.S. Employee Retirement Income Security Act of 1974 (ERISA) to resolve insecurity in class certification. It explains the evolving standard, policies, and principles of ERISA as well as its misinterpretation claims and disparate treatment of class certification. It discusses the 10b-5 requirement of individual reliance in every class member and the need to evaluate ERISA misinterpretation and nondisclosure claims given the high stakes of the litigation.
