- Abstract
The article focuses on the problem of medical malpractice insurance in the U.S. It is informed that the proposed solutions for the medical malpractice insurance crisis, damage caps and arbitration/screening panels are ineffectual and misinterpret the tort law. However, adopting certificates of merit and the use of experts to define standards of care for both the judge and the jury are considered as better ways.
