- Abstract
The article offers information on the judicial decision of the Supreme Court of Canada (SCC) in two cases including R v. Mabior and R v. DC, in which the court addressed the conviction for non-disclosure of HIV status before engaging in sexual intercourse under the section 265(3)(c) of the Criminal Code. It advocates introduction of an autonomy-based approach to develop laws for regulation and criminalization of sexual assault and avoid the risk of transmission HIV virus.
