- Abstract
The article examines violation of the Sixth Amendment or the Eighth Amendment of the U.S. Constitution by death sentencing scheme of Florida with reference to the court cases Ring v. Arizona and Hurst v. Florida. It mentions that Hurst decision of capital punishment has violated the rights of capital defendant. It discusses that in Ring case the judge used Arizona's procedure for sentencing of defendant for felony murder.
