- Abstract
The article discusses the District of Columbia Circuit court case Natural Resources Defense Council v. Environmental Protection Agency (EPA), wherein an issuance of the EPA's Fee Program Guidance (FPG) was held unwarranted in violation of the Administrative Procedure Act (APA). The Court rejected part of the FPG's content in violation of the U.S. Clean Air Act (CAA). It informs that the fee program under CAA mandates fees for nonattainment of National Ambient Air Quality Standards (NAAQS).
