- Abstract
The article analyzes several decisions from various Australian jurisdictions where the courts were asked to look at good faith in commercial contracts. It summarizes crucial facts and issues of each case and the findings in respect of good faith that were built. It is implied that choice of law, forum and drafting techniques play a role when relief is looked for on the basis of a breach of good faith. A summary list of seen trends between Australian State and Federal jurisdictions is presented.
