- Abstract
The article describes the reason for application of legitimacy presumption to same sex couples in New York. It states the policy of the public regarding presumption and why it is most vulnerable doctrine in family law of the U.S. It mentions the New York people's views on same-sex parentage before the passing of Marriage Equality Act in 2011. It explores the reason behind the application of presumption to lesbian couples is nearer to traditional concept of the presumption.
