- Abstract
The article discusses several court cases related to transfer control, free immigration and constitutional conflict. It highlights the decision of the European Court of Justice concerning a case between individuals and the Minister for Justice, Equality and Law Reform. It notes that the court ruled for the citizens under the Community free movement rules and disregarded the national immigration law. It also examines the cases before and after the Akrich family case.
