- Abstract
The article propose a more principled framework for determining permanent stay applications in criminal trials in New Zealand. Topics discussed include abuse of process pleadings, ways in which continuing the prosecution would offend the court's sense of justice; the court approaches to prevent the occurrence or continuation of an abuse of process; and a New Zealand's court case 'Moevao v Department of Labour.'
