- Abstract
The International Criminal Court (ICC) has announced its intention to issue arrest warrants for Israeli Prime Minister Netanyahu and Defense Minister Gallant in connection with the Gaza genocide. This announcement is seen as a positive development, particularly because it comes from a British Prosecutor who was previously suspected of being subservient to the British government. However, there were three surprises in the announcement: the ICC chose to announce the applications for arrest warrants before their formal approval, they did not seek an arrest warrant against General Halevi, and they sought an arrest warrant against Hamas leader Ismail Haniyeh, despite reports that he had no advance knowledge of the events in question. The Prosecutor may have made these decisions in an attempt to mitigate American fury and retaliation. It remains to be seen whether the court's independent judges will issue an arrest warrant against Haniyeh. If they do, he may choose to turn himself in and set an example for Netanyahu and Gallant.
