- Abstract
The article focuses on ascertain ability doctrine with affidavits having both prosecuted and defended large class actions under the U.S. Federal Rule of Civil Procedure 23 for defending class actions for alleged marketplace violations. It mentions the U.S. Supreme Court denied two petitions for certiorari in 2016, in Direct Digital, LLC v. Mullins and Procter & Gamble Co. v. Rikos. It also mentions class actions intensified after enactment of the Class Action Fairness Act of 2005.
