The author reflects on the criminalization of hiring practices in the U.S. under the U.S. Foreign Corrupt Practices Act (FCPA). Topics discussed include legislative history of the FCPA and its antibribery provision; the U.S. government investigations concerning the American financial institution JPMorgan's hiring program in China; and range of hiring practices subject to FCPA scrutiny.
