- Title
INDETERMINATE CONTROL OF OFFENDERS UNDER THE YOUTH CORRECTION AUTHORITY ACT: CONSTITUTIONAL ISSUES.
- Authors
MIMMS, JR., CARNEY W.
- Abstract
The article analyzes the constitutional issues to which the California Youth Correction Authority Act's provisions of indeterminate control of the offender give rise to. It discusses the Section 12 of the Act which directs commitment to the Authority to retain the offender under 21 years of age, and by which the Authority is directed to discharge the offender as soon as in its opinion there is reasonable probability that he can be given full liberty without danger to the public. It discusses the minimum-maximum sentence laws. It further distinguishes between the juvenile court acts and the defective delinquent acts.
